Online Poker in Mexico: Rooms, Legality, Payments and Taxes

Updated October 2026. This guide is for information only and is not legal or tax advice.

Yes, you can play online poker in Mexico: thousands of Mexican players do it every day, both at operators holding a permit from the Interior Ministry (SEGOB) and at international rooms that accept players from the country. What changes between the two is the legal protection you have, the payment methods available and, above all, the quality of the games and the rakeback you can recover. This guide explains the legal situation as it stands at the time of this update, which rooms you can use from Mexico, how to deposit and withdraw, what happens with taxes and which mistakes to avoid.

Is online poker legal in Mexico?

Gambling in Mexico is governed by the Federal Law on Games and Draws of 1947 and its 2004 Regulation, administered by SEGOB through its Directorate of Games and Draws. That framework predates the internet and does not specifically regulate online gambling: operators offering internet betting under a Mexican brand do so under permits issued for land-based venues and extended to online operation. Several reforms to regulate online gambling expressly have been announced in recent years; at the time of this update, none has changed the basic framework.

In practice, for the player this means:

  • Playing is not a crime. The law sanctions whoever organises gambling without a permit, not whoever takes part. No rule punishes a Mexican player for opening an account at an international poker room.
  • International rooms are not supervised by SEGOB. If you have a problem with a foreign operator, the Mexican authority will not step in; your protection is the licence the room holds in its own jurisdiction and its reputation.
  • SEGOB-permitted rooms offer that protection, but their poker offering is small: few tables, little traffic and, as a rule, no rakeback.
  • The legal age is 18. Every serious room requires identity and age verification before the first withdrawal.

Online poker rooms available from Mexico

These are the international rooms in our comparison. All of them accept players from outside Spain and the United Kingdom according to their Habwin page, but country acceptance and payment methods change often: check the room page and the sign-up form before depositing. Rakeback is the percentage of the commission (rake) you get back for playing through Habwin.

How to deposit and withdraw from Mexico

The main practical obstacle for the Mexican player is not legal but banking: many banks decline charges to foreign gambling operators and international transfers are slow and expensive. The methods Mexican players actually use at international rooms are:

  • E-wallets (Skrill, Neteller and similar): you fund them by card or local transfer and deposit and withdraw at the room from there. The most widespread method among regular players because it avoids bank declines and speeds up withdrawals.
  • Prepaid cards and vouchers (AstroPay and equivalents): bought in pesos and used like an international card. Useful for depositing; for withdrawals you need other methods.
  • Cryptocurrencies: some rooms accept direct crypto deposits and CoinPoker runs entirely on crypto. Fast and bank-free, but you take on the currency's volatility.
  • Credit and debit cards: work at some rooms and with some banks. If your bank declines the charge, do not insist: use an e-wallet.
  • Cash and SPEI through processors: some rooms offer peso deposits through local processors that accept payment at convenience stores or by SPEI transfer. It depends on the room and changes often.

Two tips: always deposit and withdraw by the same method, because that is what most rooms require under anti-money-laundering rules, and complete identity verification (INE or passport plus proof of address) on day one, not when you want to cash out.

Taxes on poker winnings in Mexico

Winnings from games of chance and betting are taxable income in Mexico. When the prize is paid by an operator with a Mexican permit, the operator itself applies the corresponding withholding. When winnings come from an international room, there is no withholding at source and the obligation to declare them falls on the player, as with any other income from abroad. If you play regularly or for significant amounts, consult an accountant: rules and thresholds change, and this guide is no substitute for professional advice.

Tips for playing online poker from Mexico

  1. Timing. Traffic at international rooms peaks in the European evening and the American night. From Mexico, the best games are usually between 5 pm and 1 am Central Time.
  2. Currency. Most international rooms operate in dollars or euros. Work out the exchange rate and conversion fees before choosing a deposit amount; moving small sums many times is expensive.
  3. Rakeback from day one. Sign up through Habwin before creating the room account: rakeback cannot be activated on an existing account.
  4. Start low. The micro-stakes tables of the big rooms have more Mexican and Latin American players than any local room, and the level is manageable.
  5. One account per room. Opening several accounts leads to closure and confiscation of the balance at every room.
  6. Limits. Every room lets you set deposit limits. Use them: playing from your phone makes it easy to play more than planned.

If you do not yet master the game, review the basic rules of poker, the hand rankings and which poker app to choose for playing on your phone.

Frequently asked questions about online poker in Mexico

Is online poker legal in Mexico?

Playing is neither prohibited nor punished. The law regulates operators, not players, and there is no specific rule for online gambling. SEGOB-permitted operators offer Mexican regulatory protection; international rooms, that of their own licence.

Which online poker room is best for Mexican players?

It depends on your volume and your hours. To maximise rakeback, Poker King and PartyPoker; for traffic and variety, PokerStars and PartyPoker; to pay in crypto, CoinPoker. Check availability on each room page.

Can I deposit in Mexican pesos?

At some rooms, yes, through local processors; at most you deposit in dollars or euros from an e-wallet, a prepaid card or crypto.

Do I have to pay tax on online poker winnings?

Gambling winnings are taxable income. Mexican operators withhold at payment; with international rooms the declaration falls on the player. Consult an accountant.

From what age can you play?

From 18. Every room verifies identity and age before allowing withdrawals.

What is rakeback and how do I collect it from Mexico?

It is the periodic refund of part of the commission the room takes from every hand. It is activated by signing up at the room through Habwin and paid according to each room's terms, usually weekly or monthly.

Responsible gambling. Poker is a game of skill with plenty of short-term luck. Play only with money you can afford to lose, with a separate bankroll, and only if you are 18 or over. If gambling is causing you problems, seek professional help.
